AEE wrote to the Federal Energy Regulatory Commission in regards to two issues of great consequence to the future of the demand response industry. First, AEE strongly encouraged FERC to support a Writ of Certiorari from the United States Supreme Court to overturn the May 23, 2014 decision by the U.S. Court of Appeals for the District of Columbia Circuit in the Electric Power Supply Association v. FERC et al. (“The D.C. Circuit Decision”). Second, AEE registered deep opposition to the Complaint filed by FirstEnergy in PJM, which poses an immediate threat to the demand response industry.
